Any failure or delay in the performance by either party hereto of its obligations under this Agreement shall not constitute a breach hereof or give rise to any claims for damages if and to the extent that it is caused by occurrences beyond the control of the party affected, including, but without limiting the generality of the forgoing, acts of governmental authority, acts of god, strikes or concerted acts of workmen, fires, floods, explosions, wars, riots, storms, earth¬quakes, accidents, acts of a public enemy, rebellion, insurrection, sabotage, epidemic, quarantine restrictions, shortages of labour, materials or supplies, failures by contractors or subcontractors, transportation embargoes, failures or delays in transportation, rules, regulations, orders or directives of any government or any state, subdivision, agency or instrumentality thereof or the order of any court of competent jurisdiction.
